These Terms of Service (“Terms”) govern your access to and use of the PoloPan mobile application, website, and any related services (collectively, the “Service”) provided by Rofoso Consumer Private Limited (“PoloPan,” “we,” “us,” or “our”). Our Privacy Policy is incorporated by reference into these Terms. By creating an account, accessing, or using our Service, you expressly agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

Service Description
PoloPan is a technology platform for fashion discovery. We aggregate product catalogs from various third-party brand and marketplace websites (“Third-Party Retailers”) to provide personalized style recommendations.
No Commercial Transactions
PoloPan is not a retailer. We do not sell any products. Our Service links to the websites of Third-Party Retailers where you can make purchases. PoloPan is not a party to, and bears no responsibility for, any transaction between you and a Third-Party Retailer.
No Product Customer Service
As we do not process any transactions, we are not responsible for handling any refunds, returns, exchanges, shipping issues, or other customer service inquiries related to products purchased from Third-Party Retailers.
User Eligibility Age
The Service is not intended for children under the age of 13. By using the Service, you affirm that you are at least 13 years old.
Term Duration
These Terms will remain in effect for as long as you are using our Service or until your account is terminated. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, license grants, warranty disclaimers, indemnity, and limitations of liability.

Account Creation
To use certain features, you must register for an account. You agree to provide accurate and complete information. Your account username may not include the name of another person with the intent to impersonate them, nor may it be offensive, vulgar, or obscene.
Account Responsibility
You are solely responsible for the confidentiality of your account credentials and for all activities conducted through your account. You may not transfer or sell access to your account. You must notify us immediately of any unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to comply with this section.
Right to Refuse or Cancel
We may refuse registration, cancel an account, or deny access to the Service for any reason, at our sole discretion.
Data Privacy & Permissions

Anonymized Data
You agree that we may collect and share anonymized and aggregated data based on your interactions (e.g., swipes, browsing) with brands and partners for market analysis.
Contact Information for Social Features
Certain “Social Features” require access to your device’s contact list. If you do not grant this permission, you will not be able to use these Social Features. You can still use the other core features of the Service.

You are solely responsible for all content you upload or share (“User Content”). By posting User Content, you grant PoloPan a non-exclusive, transferable, worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute your User Content in connection with operating and promoting the Service.
Code of Conduct
You agree that you will comply with all applicable laws and will not use the Service to:
Post any content that is inaccurate, unlawful, fraudulent, defamatory, obscene, or otherwise objectionable, or that infringes on any third party’s intellectual property rights.
Impersonate any person or entity.
Engage in spamming, phishing, or flooding.
Harvest or collect information about other users without their consent.
Use the Service for any commercial purpose without our prior written approval.
Copyright Policy
PoloPan respects the intellectual property of others. If you believe your copyright has been infringed upon by content on our Service, please provide our Copyright Agent with a notice containing:
(a) identification of the copyrighted work;
(b) identification of the infringing material to be removed;
(c) your contact information;
(d) a statement of good faith belief that the use is not authorized; and
(e) a statement that the information is accurate and that you are authorized to act on behalf of the copyright owner.

Catalog & Recommendation Accuracy
The product information on our Service is sourced from Third-Party Retailers. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY PRODUCT INFORMATION.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ROFOSO CONSUMER PRIVATE LIMITED BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO POLOPAN IN THE PREVIOUS 12 MONTHS, OR (B) ONE THOUSAND INDIAN RUPEES (INR 1,000).
Indemnification
You agree to defend, indemnify, and hold harmless Rofoso Consumer Private Limited from any claims, damages, losses, and expenses (including attorney’s fees) arising from: (i) your use of the Service; (ii) your violation of these Terms; or (iii) your User Content.
Termination
We may investigate any violation of these Terms. If we determine you have violated these Terms or the law, we may, without notice, cancel your account, delete your User Content, and prevent you from accessing the Service. You agree that monetary damages may not be a sufficient remedy for certain violations and consent to injunctive or other equitable relief. You will still be bound by your obligations under these Terms even after termination.

Governing Law
These Terms shall be governed by the laws of the Republic of India.
Jurisdiction
You agree that any legal action or proceeding shall be brought exclusively in the competent courts located in New Delhi, India.
General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
Feedback
We welcome your feedback, comments, and suggestions (“Feedback”). By submitting Feedback, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use and exploit the Feedback for any purpose without any compensation or restriction.
Electronic Communications
